A) in place of the Amended Complaint filed pursuant to this Court’s Order dated January 10, 2008. (Doc. 34). In support of this Motion, Plaintiffs state as follows: 1. The Plaintiffs filed their Amended Complaint to remove the class allegations on January 22, 2008. (Doc. 35). 2. In addition to removing the class allegations, the Plaintiffs incorrectly added Dennis Barry as a party defendant in the case. Thus, the Plaintiffs seek to correct this error by removing Dennis Barry as a named defendant in this lawsuit. 3. Additionally, the Plaintiffs did not remove the Fictitious Defendants AA through ZZ from the Amended Complaint as required by Rule 10(a) F.R.C.P. As a result, the Plaintiffs seek to correct this error by removing the Fictitious Defendants AA through ZZ from the Amended Complaint filed on January 22, 2008. A hereto) in place of the Amended Complaint filed on January 22, 2008. 5.
