INTRODUCTION On August 17, 2018 Defendants Burch & Company, Inc. and Anton Randal Burch (together “Burch Defendants”) served a Memorandum of Costs (Summary) and Memorandum of Costs (Worksheet) (together the “Cost Memorandum) seeking recovery of $7,488.24 in costs against Plaintiffs Lorelei Mooney,as trustee and on behalf of the Herbert and Helen Schweiger Trust, ARI-DFW East & West 9, L.P., Gary Lamm and James Mieuli (collectively “Plaintiffs”). (Declaration of Kenneth J. Catanzarite, Esq. [“Catanzarite Decl.”], Exhibit A.) For the reasons detailed below, the amount of costs requested for electronic filing and service must be taxed in the amount of $120.00, and the “other” costs amounting to $1,809.84 must be stricken and/or taxed from the total costs requested by Burch Defendants. II. ARGUMENT & AUTHORITY A. Legal Standard. In ruling on a motion to tax costs, the trial court is to determine whether Code of Civil Procedure section 1033.5 expressly allows the particular itemized cost, and whether it appears proper on its face. If so, the burden is on the objecting party to show the cost to be unnecessary or unreasonable. Nelson v. Anderson (1999) 72 Cal App. 4th 111, 131, as modified on denial of reh'g (June 14, 1999). If a defendant’s requested costs appear proper on their face, a party subject to liability for costs may seek to reduce the claimed items or the amount of the claimed costs, based on the circumstances under which the costs were incurred. For example, costs recoverable under Code of Civil Procedure section 1032 are restricted to those that are (1) reasonably necessary to the conduct ofthe litigation and (2) reasonable in amount. Code Civ. Proc., § 1033.5(c)(2); Nelson, 72 Cal. App. 4th at 130. The total costs claimed may include unreasonable or unnecessary costs; and may therefore be reduced to costs which are reasonable and necessary to the litigation. Id. Once items in a cost memorandum are properly objected to, the burden of proof is placed on the party claiming them as costs. Ladas v. California State Auto Assn. (1993) 19 Cal.App.4th 761, 774. Code, § 500. B. Item No. 14 for Fees for Electronic Filing or Service. Until early 2015 this case was pending in Los Angeles County Superior Court and utilizing Case Anywhere. While the first four entries for Item No. 14 coincide with usage of Case Anywhere, the last item for a quarterly e-service fee of $120.00 dated May 21, 2016 is long after the case transferred to Orange County Superior Court after which no such fee would have or should have been incurred. (Catanzarite Decl., Ex. B hereto.) Accordingly, the amount of costs requested for Item No. 14 in the amount of $585.60 must be taxed by $120 since such amountis not allowable as neither reasonably necessary to the conduct ofthe litigation nor reasonable in amount. C. Item No. 16 for Other Costs. The category of “Other” costs expressly allows for recovery of costs only where “required to be awarded to the prevailing party pursuant to statute” incident to prevailing in the action. Code Civ. Proc., § 1033.5(a)(16). Burch Defendants seek $1,809.84 of “Other” costs which, per their Worksheet, consists of $24.24 for InterCall, $465.60 for Case Anywhere, and $1,320.00 for CourtCall. (Ex. A at Worksheet Item No. 16.) The Cost Memorandum does not identify a statutory basis requiring that these “Other” costs be awarded and Plaintiffs are aware of no statutory basis for same. CourtCall costs are not identified as an allowable cost and are purely convenience costs. Convenience costs are administrative and overhead costs and, as such, are not awardable. Ladas, 19 Cal.App.4th at 774-775. InterCall appears to be a conference call service provider and such a cost is, like CourtCall, not an allowable cost and purely one for convenience. Costs of $465.60 for CaseAnywhere are improper. The total amountis duplicative of the first four quarterly e-service fee entries under Item No. 14 which costs coincide with use of CaseAnywhere during the time this case was pending in Los Angeles County Superior Court. Duplicative costs necessarily are not reasonably necessary to the conduct ofthe litigation nor reasonable in amount.
