THIS CAUSE coming to be heard on the Joint Motion of the Third-Party Plaintiffs,
ADRIAN CARRIERS, LLC., GREGORY HORNE, and the Third-Party Defendant, 5 STAR
LOGISTICS, LLC, for the dismissal of the Third-Party Complaint, due notice having been given;
IT IS HEREBY ORDERED that:
1. Count I of the Third-Party Complaint is dismissed with prejudice and without costs.
2. The Court finds that the Dismissal of Count I has been made in good faith under
the Illinois Contribution Act.
3. The Court further finds that the dismissal of Count I is a final judgment based upon
the Court’s finding that there is no just reason for delay of enforcement or appeal under Rule 54(b).

4. Counts II and III of the Third-Party Complaint are voluntarily dismissed under Rule
41 without prejudice and without costs.
