On February 27, 2019, Plaintiff filed a Motion To Dismiss For Lack Of Jurisdiction, on the grounds that the Court no longer had any subject matter jurisdiction in view of Plaintiff’s statutory disclaimer all claims of the only patents in suit. (Dkt. 111). The law is detailed in the Motion, and it is plain and unequivocal that the Court cannot continue any action where the only patents in suit that have been disclaimed. Given the lack of subject matter jurisdiction, BMW’s motion for summary judgment of non-infringement and invalidity of the disclaimed patents is moot as a matter of law, and cannot be considered by the Court. Nevertheless, to avoid any dispute, Plaintiff provides the above observation in response to BMW’s Motion.
