(“Apple”) and the contract manufacturers—Compal Electronics, Inc.; FIH Mobile Ltd.; Hon Hai Precision Industry Co., Ltd.; Pegatron Corporation; and Wistron Corporation (collectively, the “CMs”)—oppose Qualcomm’s Ex Parte Application for Additional Trial Time (Dkt. 778). In the parties’ Final Pretrial Conference Order, lodged on November 27, 2018, Apple and the CMs proposed a 14-day trial, not including jury selection. Qualcomm proposed a 20.4-day trial, not including jury selection. (Jan. 22, 2019 Declaration of Edward H. Takashima, ¶ 5). On December 19, 2018, following the parties’ pretrial conference, the Court allocated “35 hours per side for evidence,” which at 5 hours per day translates to 14 trial days. (Dkt. 749). The Court was aware of all of the issues now raised by Qualcomm when it set that trial schedule, including the number of claims to be tried, the complexity of the issues, the breadth of discovery, and the parties’ extensive pretrial exchanges. Qualcomm has not cited any new developments that would warrant additional trial time. There are none—and thus there is no reason for the Court to revisit its December 19, 2018 Order. Apple and the CMs are confident that the parties will be able to streamline their evidence and efficiently present their cases within the four-week schedule set by the Court. If, however, the Court sees fit to grant Qualcomm’s ex parte application, Apple and the CMs ask that the Court divide any additional time equally between Qualcomm, on one hand, and Apple and the CMs, on the other hand. Apple and the CMs’ understanding is that the time limit of “35 hours per side for evidence” applies to only the presentation of evidence and does not include opening statements, closing arguments, or jury selection and instruction.
