I, AARON YU, hereby declare as follows: CODE §8102) 1. | am a Deputy City Attorney representing the City of San José in the above-captioned matter. 2. On March 29, 2021, the City of San José filed a Petition Re: Disposition of Weapons seeking forfeiture of firearms that police officers confiscated from the residence of Respondent ANTHONY LAWRENCE LEE when the officers detained him on February 28, 2021 for psychological evaluation pursuant to Welfare & Institutions Code §5150. On May 7, 2021, the City Attorney’s Office mailed a notice letter informing Respondent that he was required to respond to the Court to request a hearing on this matter within thirty days. The letter also informed Respondent that failure to respond would result in an Order of Default. 4. On May 13, 2021, the notice was returned as unable to forward. On March 17, 2021, the City served Respondent with notice via email at aleerecovery@gmail.com, which Respondent provided to San Jose police officers on February 28, 2021. 5. On July 7, 2021, | called Respondent on the cell phone number provided in SJPD Report# 21-059-0564 and left a voice message informing him we would file a Petition for Default, and that he call me back if he intended to contest the petition. As of this date | have not heard back from him. 6. As of this date, the City Attorney’s Office has not received notice from or on behalf of LEE requesting a hearing. The Court’s file should reflect that no such request has been filed. | declare under penalty of perjury that the foregoing is true and correct.
