Plaintiffnow requests an order to publish the summons and complaint in a newspaper of general circulation. MEMORANDUM OF POINTS AND AUTHORITIES I. BACKGROUND This case stems from a motor vehicle accident that occurred on April 8, 2019 in Mountain View, CA. Mountain View police responded to the scene of the accident and took a report. Plaintiff filed the instant lawsuit against the responsible driver and owner of the subject vehicle. Plaintiff’s EX PARTE APPLICATION (n . Plaintiff’s counsel has caused a process server to attempt service ofprocess on all three defendants with negative results. Plaintiff’s counsel has caused online searches to be conducted and has mailed the notice of acknowledgement of receipt to defendants’ last known address. Plaintiff’s counsel now seeks an order to publish the summons and complaint in a newspaper of general circulation. II. LEGAL AUTHORITY California Code of Civil Procedure Section 415.40 permits a summons to be served upon the defendant by publication upon demonstration by affidavit that the party cannot be served with reasonable diligence personally, by mail, or by substitute service and that the party, and that a cause of action exists against that party, or that person is a necessary party, or the party claims an interest in real or personal property that is subject to the jurisdiction of the court. In the present case, the plaintiff has asserted a cause of action against the defendants, and for the reasons explained in the attached declaration, cannot with reasonable diligence locate the defendants. For these reasons, the plaintiff asks that the court permit the service of the summons by publication. DECLARATION OF NOEL D. HIBBARD IN SUPPORT 0F EX PARTE APPLICATION I, Noel D. Defendant, Ferdy Pan was listed as the registered owner of the subject vehicle driven by defendant, Pedro Lucero; 7. On information and beliefEdy Lucero may be another owner of the subject vehicle; 8. The address for defendants on the police report was listed as 570 S RengstorffAve #5 6, Mountain View, CA. 9. I caused a process server to go to the location and attempt service of process on Pedro Lucero on: 5/5/21; 5/6/21; 5/10/21; 5/1 1/21; 5/12/21. 10.
