California Code of Civil Procedure section 581 allows a plaintiff t0 voluntarily dismiss a case before “commencement 0f trial.” Code CiV. Proc. § 581(b-c). Subdivisions (b) and (c) of the California Code 0f Civil Procedure section 581 provide in part: “(b) An action may be dismissed in any 0f the following instances: (1) With 0r Without prejudice, upon written request of the plaintiff to the clerk, filed with papers in the case, 0r by oral or written request t0 the court at any time before the actual commencement 0f trial, upon payment of the costs, if any. . . . (c) A plaintiff may dismiss his 0r her complaint, or any cause 0f action asserted in it, in its entirety, or as to any defendant 0r defendants, with or without prejudice prior to the actual commencement 0f trial.” California Rules 0f Court, Rule 3.770(a) requires court approval of the dismissal of a class action, or of any party 0r cause 0f action in a class action, and requires a declaration in support 0f the dismissal.
