Caltech makes this motion on the grounds that Defendants Broadcom Limited, Broadcom Corporation, Avago Technologies Limited, and Apple Inc.(“Defendants”) cannot prove by clear and convincing evidence that any information that was but-for material to the patentability of any asserted patent was withheld from the United States Patent & Trademark Office (“USPTO”) with specific intent to deceive by any person with a duty of disclosure. This motion is based on this Notice of Motion and Motion; the concurrently- filed Memorandum of Points and Authorities in Support of Caltech’s Motion for Partial Summary Judgment of No Inequitable Conduct; the concurrently-filed Declarations of Margaret Shyr, Hui Jin, Ph.D. and Aamod Khandekar, Ph.D. (and all exhibits thereto); Caltech’s Statement of Uncontroverted Facts and Conclusions of Law in Support of Plaintiff’s Motion for Summary Judgment; the concurrently- lodged [Proposed] Order Granting Caltech’s Motion for Summary Judgment; the files and records in this action; and any such additional argument or materials as may be submitted to the Court before the time of the decision in this matter.
