California Business & Professions Code §l7200 Unlawful Business Practice, Unfair Business Praqctice 2. Califomia Civil Code§ 1714 Negligence The Plaintiff charged-off and sold my debt t0 another company. Both companies are reporting negative credit for the same debt. This creates credit scores which are falsely and inaccurately low. POINTS In 2015 and 2016 Capital One, Bank ofAmerica and Citibank retroactively deleted all accounts they sold to debt buyers and they still do it. Why: The two separate credit report trade lines containing negative information regarding the same debt damage the FICO credit scores twice. One piece of damage is by the Original Creditor‘s reporting, another piece of damage is by the debt buyer. This is not accurate. Nearly all credit and lending decisions are made by computer algorythms. The computer credit decision engines cannot discern between an Original Creditor and a Debt Buyer regarding negative credit information nor can the computer add back credit score points for the double-reporting.. The computer algorythms rely heavily on the FlCO credit scores for credit decision making & credit acceptance, offers or declines. The Plaintiff‘s credit reporting causes inaccurately low FlCO scores that is sufficient to "adversely affect credit decisions". AUTHORITIES l. Sepulvado v. CSC Credit Services, lnc.158 F.3d "A credit entry may be 'inaccurate' within the meaning of the statute either because it is patently incorrect, 0r because it is misleading in such a ways and to such an extent that is can be expected to adversely affect credit decisions." 2.
