NO. 1:17-cv-903 (CMH/TCB) PLAINTIFF CANADA GOOSE INC.’S MEMORANDUM IN SUPPORT OF ITS MOTION TO AMEND/CORRECT JUDGMENT COMES NOW THE plaintiff, Canada Goose Inc. (“Canada Goose”), by counsel and pursuant to Rule 60(b) hereby moves to Amend/Correct the Judgment of this Court entered on January 23, 2019 on the grounds that such amendment is necessary to effectuate the Court’s prior ruling. Dkt. 34. As grounds therefore, Canada Goose states as follows. Pursuant to Fed. R. Civ. P. 55, Canada Goose previously moved and obtained a default judgment against defendant Registrant of CanadianGoose.com (“Registrant”) and the domain name CanadianGoose.com (the “Infringing Domain Name”) (collectively, “defendants”) pursuant to Fed. R. Civ. P. 55(b)(2). Dkt. 34. In this in rem action, Canada Goose sought a default judgment and an order directing the registry to transfer the Infringing Domain Name to Canada Goose. Defendants did not respond to the Complaint or Amended Complaint, despite being properly served with process, and although the time for responding passed. Case 1:17-cv-00903-CMH-TCB Document 37 Filed 02/21/19 Page 1 of 4 PageID# 509 2 Accordingly, the clerk entered the default of the defendant Registrant of CanadianGoose.com on August 6, 2018. Dkt. 28. On December 4, 2018, upon de novo review of the Report and Recommendation of the Magistrate Judge, Dkt. 33, this Court on January 23, 2019 then entered an Order affirming the findings of the Magistrate Judge and entering default judgment in favor of Canada Goose against the Registrant for violations of the Anti- Cybersquatting Consumer Protection Act, 15 U.S.C. § 1125(d)(1)(C) which ordered that Verisign, Inc. (“Verisign”) and the individual registrar, Uniregistrar cooperate with a registrar to be appointed by plaintiff Canada Goose to re-register the domain name in Canada Goose’s name and under Canada Goose’s ownership pursuant to 15 U.S.C. § 1125(d)(1)(C). Dkt. 34. For technical reasons, however, it is not possible to effectuate the transfer of the domain name at issue to Canada Goose without slight modification of the language of the final Order. Accordingly, Canada Goose prays that the final Order be amended to enable the domain name to be transferred to Canada Goose by including the following language. It is further ordered that VeriSign, Inc. effectuate transfer of the domain name to Plaintiff pursuant to 15 U. S. C. § 1125(d)(1)(C) by changing the registrar of record in the authoritative.com registry database from Uniregistrar Corp. to a registrar designated by Plaintiff. This request is made in good faith to allow for the obtainment of the requested relief for the good cause previously shown. For the reasons discussed above, Canada Goose requests that the Court amend its prior Order against the Registrant of CanadianGoose.com and the Infringing Domain Name and that an amended judgment be entered in favor of Canada Goose Inc. on its claim under the Anticybersquatting Consumer Protection Act, 15 U.S.C. § 1125(d) as requested above.
