On October 5, 2011, the Board announced that it will postpone the implementation date for its new notice posting rule from November 14, 2011, until January 31, 2012. No other changes to the rule are currently planned.
The decision to postpone the effective date is the result of several businesses questioning whether their business falls under the Board’s jurisdiction. A few businesses even filed lawsuits that challenged the Board’s authority to require companies to put up the poster. The Board believes that by postponing the effective date it will be able to (1) reach out to employers to educate them with regarding the applicability of the National Labor Relations Act, and (2) ensure more broad voluntary compliance.
