Speedy Trial, Continuance, Waiver

Criminal Law Update

Zedner v United States,547 US 489; 126 S Ct 1976 (2006)(june'06). A defendant may not prospectively waive application of the Speedy Trial Act.The act does not exclude delay periods prospectively waived by a defendant. Although complete waivers are permitted, there is no indication Congress intended to allow prospective waivers, and such waivers would be contrary to the public interest in prompt trial proceedings. The failure to make findings in support of a continuance can never be harmless error.Defendant was not estopped from raising the issue.
