President Bush Signs CAN-SPAM Act of 2003

Privacy, Data Protection and Information Security Alert

On December 16, 2003, President Bush signed the CAN-SPAM Act of 2003 (Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003). This law will affect all U.S. businesses that send commercial messages via e-mail. It was passed in response to the ever growing deluge of unsolicited commercial e-mail, otherwise known as “spam” - as well as the increasing Babel of state laws that prohibited or regulated spam in inconsistent ways, some of which threatened the ability of businesses to communicate with their customers.
