Jackson Lewis Affirms Support of 'At Will' Employment Agreements

Jackson Lewis and the Atlantic Legal Foundation have filed a Friend-of-the-Court (amicus curiae) brief in the California Supreme Court in support of an employer's right to terminate the employment of an individual at will. The brief seeks reversal of a Court of Appeal decision, Dore v. Arnold Worldwide LLC . In the decision, an employment letter that stated employment was "at will" and could be terminated "at any time," was characterized as ambiguous because it did not include the phrase "without cause."

If allowed to stand, the Court of Appeal decision would have a far-reaching negative impact. For instance, the retroactive application of the decision to existing at-will agreements would allow any current or former employee whose employment contract does not contain the words "without cause" to sue a current or former employer.
