SC – The operators of a Holiday Inn Express will pay $90,000 to settle a sexual harassment and retaliation lawsuit. The suit alleged that management subjected several female employees to a sexually hostile work environment including sexual advances, comments, and unwelcome touches by a general manager.
CA – Giumarra Vineyards will expend $350,000 to resolve a discrimination and retaliation case affecting up to 3,000 employees. The suit alleged that a female migrant worker was sexually harassed and that many other workers were subjected to retaliation. The company will devote part of the settlement figure to conduct training on sexual harassment and retaliation for its migrant farmworkers and staff.
NC – An Asheboro sewing contractor will pay $75,000 to settle a national origin harassment lawsuit. The suit alleged that a Hispanic employee had to quit his job to escape derogatory names including “wetback” and “half-breed.” Despite complaints to management, the company failed to address the harassment.
WA – Best Western Hotels will pay $365,000 to settle a suit for harassment. The suit charged that the general manager at a Tacoma location persistently harassed and denigrated women. Female employees were subjected to racial slurs, belittling remarks about their religious beliefs, derogatory sex-based comments, yelling, and physical intimidation. The manager also illegally fired five women after they revealed they were pregnant.
VA – RCC Consultants, Inc. will pay $45,000 to settle a disability discrimination lawsuit. The suit alleged that the company discriminated against an applicant for a managing consultant position because of his vision problems. The man’s original job offer was rescinded when the company learned he could not drive due to his disability. He was still qualified to perform the duties of the position.
FL – A Florida-based tomato grower and producer will pay $150,000 to settle a sexual harassment lawsuit. The suit alleged that two female farmworkers were sexually harassed by a supervisor and then fired when they opposed the conduct.
TX – Blue Ridge Resources, LLC, will pay $43,000 to three former oil rig workers to settle a national origin harassment suit. The suit alleged that a Hispanic boss created a hostile work environment when he mistreated his crew by repeatedly referring to them as “wetbacks” and “dirty Mexicans.”
WI – An owner and franchisee of 25 McDonald’s will pay $1M to resolve a class sexual harassment lawsuit. The suit alleged that the owner permitted male employees to abuse multiple women, including teens, at one of his locations. Some of the women were fired for complaining; three filed charges with the EEOC.
HI – Hawaii Healthcare Professionals, Inc. will pay $190,000 in an age discrimination suit. The company owner referred to the employee as a “bag of bones” and said she was not the type of person to be representing the company. The employee was terminated despite reports by the facility manager that she was a good worker.
NC – The Goodyear Tire & Rubber Company will pay $20,000 to settle a disability discrimination suit. The suit alleged that a job applicant who had obtained a conditional offer of employment was ordered to obtain medical clearances after disclosing she had a bleeding disorder associated with her menstrual cycle. She was cleared to work, but was fired three weeks later after disclosing her condition to her supervisor.
MD – A federal jury has awarded $350,000 to three former employees of a Baltimore-area medical practice. The suit alleged that three employees were subjected to unwanted sexual advances by both the CEO and CFO. They were retaliated against by being denied unpaid leave without cause.
OK – Kids R Us Childcare will pay $75,000 to settle a pregnancy bias and retaliation suit. The suit alleged that an employee of the company was demoted from full-time assistant facility director to part-time cook after revealing her pregnancy. After filing a charge with the EEOC, the company transferred the pregnant employee to a facility further from her home, effectively forcing her to resign.
TX – A subsidiary of BAE Systems will pay $55,000 to settle a disability discrimination suit. According to the lawsuit, a qualified material handler was fired because of his obesity. The company did not engage in any discussion with the employee to determine whether reasonable accommodations could be made so that he could continue to work.
AZ – Banner Health will pay $225,000 to settle a disability discrimination lawsuit. The suit alleged that the health care company fired a worker because of his intellectual disability, breaching a mediation agreement in which the company would not take any action against him without first consulting his brother who had his power of attorney. The worker was a dietary aid who was able to perform his job when he received supervision sensitive to his needs.
GA – A senior living facility will pay $94,000 to settle a pregnancy discrimination suit. The suit alleged that the company fired both an assistant chef and personal care aide because of their pregnancies. After announcing their pregnancies, both employees were written up for performance issues and discharged.
VA – A shipyard contractor will pay $80,000 to settle a retaliation suit. The suit alleged that two temporary employees were discharged from work after reporting that a female supervisor had been kneeing male subordinates in the groin.
