Prime Medica Assocs. v. Valley Forge Insurance Co., 2009 PA Super 39 (March 5, 2009)

Holding: Where an insured brings a claim after the time limit specified in an insurance contract’s suit limitations clause, the insurer may assert the defense of waiver or estoppel. As a result, the insured must present evidence to establish that it had reasonable grounds for believing that the time limit would be extended or that the insurer would not strictly enforce a suit limitations provision.
