On January 26, 2018, the Region issued an amended consolidated complaint which deleted certain of the allegations at issue in the Respondent’s motion. On February 12, 2018, the Region issued a notice of intent to further amend the amended consolidated complaint. In light of the amendments and intent to further amend, the Respondent has failed to establish that there are no genuine issues of material fact warranting a hearing and that it is entitled to judgment as a matter of law. This denial is without prejudice to the Respondent’s right to renew its arguments to the Administrative Law Judge and before the Board on any exceptions that may be filed to the judge’s decision, if appropriate.
