Sep. 10, 2019) Copy Citation 1 UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD WEST SUBURBAN CONSOLIDATED DISPATCH CENTER Employer and Case 13-WH-240309 THE ILLINOIS FRATERNAL ORDER OF POLICE LABOR COUNCIL Petitioner CERTIFICATION OF REPRESENTATIVE AS BONA FIDE UNDER SECTION 7(B) OF THE FAIR LABOR STANDARDS ACT OF 1938 On April 26, 2019, the Illinois Fraternal Order of Police Labor Council (the Petitioner) filed with the Regional Director for Region 13 of the National Labor Relations Board a request for certification of representative as bona fide under Section 7(b) of the Fair Labor Standards Act of 1938 (FLSA), 29 U.S.C. § 207(b). On May 6, 2019, the Regional Director for Region 13 served on the parties a Notice to Show Cause why the Board should not grant the request. No response was received. As the Region’s investigation revealed that the Petitioner is the recognized exclusive collective-bargaining representative of the unit employees,1 the Regional Director recommended to the Board that the requested certification be issued. 1 The record indicates that the Employer is a public sector employer, and that the Employer and the Petitioner entered into a collective-bargaining agreement that was effective by its terms from January 1, 2016 through December 31, 2018, or until a successor agreement is executed between the parties, whichever later occurs. The record also includes a copy of the Corrected Certification of Representative issued on July 12, 2002, by the Illinois Labor Relations Board, naming the Petitioner as the exclusive representative of the unit employees. 2 No party having shown cause why the requested certification should not be issued, the National Labor Relations Board certifies that the Illinois Fraternal Order of Police Labor Council is a bona fide representative, for purposes of Section 7(b) of the FLSA, of the employees of West Suburban Consolidated Dispatch Center in the following unit:2 Included: All full-time Telecommunicators and Lead Telecommunicators employed by the West Suburban Consolidated Dispatch Center. Excluded: All part-time Telecommunicators, Director, Supervisor, Secretary, all other employees of the Dispatch Center, supervisory, managerial, professional, short-term and confidential employees within the meaning of the Illinois Public Labor Relations Act; and all other persons excluded from coverage under the Act.
