On August 31, 1942;'National Labor Relations Board issued a De- cision and Direction of Election in the above-entitled proceeding., Pursuant to the Direction of.Election, an election by secret ballot was, conducted on September 22, 1942, under the direction and supervision of the Regional Director for the Fourteenth Region (St. Louis, Mis- souri). On September 23, 1942, the Regional Director, acting pur- suant to Article III, Section 9, of National Labor Relations Board Rules and-Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or to the Election Report have been filed by any _ of the parties. As to the balloting and its -results, the Regional Director reported as follows : Number of names on' eligibility, list__________________________ 199 Total number of ballots cast________________________________ 176 Number of ballots challenged________________________________ 3 Number of blank ballots____________________________________ 0 Number of void ballots_____________________________________ 2 Total number of valid votes counted_________________________ 171 Number of ballots voted for United Brick and Clay Workers of America, Local No. 806, AFL______________________________ 76 Number of ballots voted against United Brick and Clay Work- ers of America, Local No. 806, AFL________________________ 95 Since the number of challenged ballots cannot affect the results of the election, we find it unnecessary to make any determination with respect to them. We shall therefore dismiss the petition for investigation and certifica- tion of representatives of employees of the Company. ORDER By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act and pursuant to Article III, Sections 8 and 9, of National Labor Rela- tions Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the petition for investigation and certifi- cation of representatives of employees of Walsh Refractories Corpora- tion, Vandalia, Missouri , filed by United Brick and.Clay Workers of America, Local No. 806, affiliated with the American Federation, of Labor, be, and it hereby is, dismissed.
