Nov. 27, 2019) Copy Citation UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD UTILITY WORKERS UNITED ASSOCIATION, LOCAL 537 and Case 06-CB-235968 PENNSYLVANIA AMERICAN WATER COMPANY ORDER TRANSFERRING PROCEEDING TO THE BOARD and NOTICE TO SHOW CAUSE On October 16, 2019, Pennsylvania American Water Company (the Employer) filed with the National Labor Relations Board a motion for partial summary judgment on the grounds that the collective-bargaining agreement between the Employer and the previous exclusive representative of the Respondent’s unit employees remains in effect and relieves the Respondent of an obligation to bargain for an initial agreement. Having duly considered the matter, IT IS ORDERED that the above-entitled proceeding be transferred to and continued before the Board in Washington, D.C., and the hearing scheduled for November 18, 2019 be postponed indefinitely. NOTICE IS GIVEN that any party seeking to show cause why the Employer’s motion should not be granted must do so in writing, filed with the Board in Washington, D.C., on or before December 11, 2019 (with affidavit of service on the parties to this proceeding). If a response to this Notice to Show Cause is filed, a party may file a reply to the response within 7 days of receipt of the response (with affidavit of service on the parties to this proceeding), 2 but further responses will not be permitted except where there are special circumstances warranting leave to file such a response.
