Case No. R-92369 CERTIFICATION OF REPRESENTATIVES May' 13, 1941 On April 7,1941, the National Labor Relations Board issued a Deci- sion and* Direction of Election in the above-entitled proceedings.' Pursuant to the Direction'of Election, an election by secret ballot was conducted on April 18, 1941, under the direction and supervision of the Regional Director for the Eighth Region (Cleveland, Ohio). On April 25,,1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series S, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or the Election Report have been filed by 'any of the parties. B., No. 138. • 839 840 DECISIONS OF NATIONAL LABOR RE'LATION'S BOARD IT IS HEREBY CERTIFIED that The Independent, Workers Association has been designated and selected by a majority of all production and maintenance employees at the, Cleveland plant of The National Cop- per and Smelting Co., Cleveland, Ohio, including working foreman, watchmen, and student employees, but excluding the superintendent, assistant superintendent, clerical employees, and timekeepers, as their representative for the purposes of collective bargaining, and that, pur- suant to Section 9 (a) of the National Labor Relations Act, The Inde- pendent Workers Association is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
