Pursuant to the Direction of Elec- tion, an election by secret ballot was conducted on January 4, 1940, under the direction and supervision of the Regional Director for the Eighth Region (Cleveland, Ohio). On January 5, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. I. 0.) --------- 305 Total number of votes for Employees of The DeVilbiss Company Association----------------------------------------------- 71 Total number of votes for none of these organizations -------- 11 Total number of blank ballots------------------------------ 1 Total number of void ballots -------------------------------- 0 Total number of challenged votes--------------------------- 6 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Re- lations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations- Series 2, IT IS HEREBY CERTIFIED that Local No. 12, International Union, United Automobile Workers of America, affiliated with the Congress '18 N. L. R. B. 187. 19 N. L. R. B., No. 696 THE DEVILBISS COMPANY 697 of Industrial Organizations, has been designated and selected by a majority of all employees of The DeVilbiss Company, at its Toledo, Ohio, plant, engaged in production and maintenance work; including shipping and receiving clerks, stockroom clerks, and timekeepers, excluding foremen and other supervisory employees with power to hire and fire, time-study men, office employees, and employees in the engi- neering and drafting department, as their representative for the pur- poses of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Local No. 12, International Union, United Automobile Workers of America, affiliated with the Congress of Industrial Organizations, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages , hours of employment, and other conditions of employment. .
