GOODRICH COMPANY and LOCAL UNION No. 194, UNITED RUBBER WORKERS OF AMERICA Case No. R-2366 CERTIFICATION OF REPRESENTATIVES May 8, 1941 On March 22, 1941, the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Election in the above-entitled proceeding." Pursuant to the Direction of Elec- tion, an election by secret ballot was conducted on April 11, 1941, under the direction and supervision of the Regional Director for the Tenth Region (Atlanta, Georgia). ' On April 17, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Election Report. No objections to the' conduct of the ballot or the Eelection Report have been filed by any of the parties. The Regional Director reported the following results of the balloting : Total number eligible to vote______________________________ 359 Total ballots cast ----------------------------------------- 350 Total ballots cast for Local Union No. 194, United Rubber Workers of America, affiliated with the C. I. 0.__________- 179 Total ballots cast against the aforementioned union-------- 167 Total blank ballots_______________________________________ 0 Total void ballots ------------ -____________________________ 0 Total challenged ballots___________________________________ 4 Since the number of challenged ballots cannot affect the result of the election, we find it unnecessary to pass upon the challenges. By virtue of and pursuant to the power vested in -the National Labor Relations Board by Section 9: (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Local Union No. 194, United Rubber Workers of America, affiliated with the C. I. 0., has been designated -130 N . L. R. B. 518. 31 N. L. R. B., No. 110. 672 THE B. F. GOODRICH COMPANY 673 ,and selected by a majority of all piece-work and hourly rated clock card factory employees engaged in the manufacture of rubber prod- ucts in the Clarksville plant of the B. F. Goodrich Company and in the maintenance of said Clarksville plant, excluding supervisory em- ployees, clerical employees , and full time plant protection employees, as their representative for the purposes of collective bargaining, and that pursuant to Section 9 (a) of the Act,- Local Union No. 194, United Rubber Workers of America, affiliated with the C . I. 0., is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages , hours of employment , and -other conditions of employment.
