Direction of Election is denied as it raises no substantial issues warranting review.1

1 In denying review, we agree with the Acting Regional Director that the record does not establish that the planned
closure of the refrigeration department is certain and imminent. In support of its contention, the Employer has
attached a letter to the petitioned-for employees dated April 11, 2013, purportedly notifying them of a June closure
of the Juncos refrigeration department. As this letter postdates the hearing by two days, we shall treat it as an offer
of proof. Upon reviewing the letter, we find that it is insufficient to warrant a different result than that reached by
the Acting Regional Director.
