DIRECTION June 12, 1942 On January 30: 1942, the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Elections in the above-entitled -proceedings,' directing that separate elections by secret' ballot be conducted among certain employees of Redfern Lace Works, Inc., Somerville, New Jersey, herein called the Company, who were employed in the Company's Bell Avenue plant and Doughty Avenue plant. On March 31, 1942, the Board issued a Supplemental Decision and Second Direction of Election,2 directing that a new elec- tion be held among the employees at the Doughty Avenue plant. Pursuant to the Second Direction of Election, an election by secret ballot was conducted on- April 30, 1942, under the direction and super= vision of the Regional Director for'the Second Region (New York City). On May 30, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules'aind Regulations-Series 2, as amended, issued and duly served upon the parties a Second Election Report. . No objections to the conduct of the ballot or to the Second Election Report have been filed by any of the parties. L. 0. of A-- 23 -Votes cast for neither union--------------------------------- 0 With' respect to the 21 challenged ballots, the Regional Director rec- ommended that the challenges be overruled as to 18 and sustained as to the ballots of Catherine Dinunzio, Ruth Abbott, and Ethel Gorman. None of the parties has objected to the Regional Director's recom- mendations. We have considered the Election Report and adopt the Regional Director's recommendations'; accordingly, we shall direct that the Regional Director open and count the.18 ballots and thereafter prepare and serve on the parties a Supplemental Election Report. DIRECTION By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act,_ 49 Stat. 449, and pursuant to Article III, Sections 8' and 9, of National Labor-Relations-Board Rules and Regulations-Series 2, as amended, it is hereby DIRECTED that, as part of the investigation ordered by the Board to ascertain representatives for the purposes of collective bargaining with Redfern Lace Works, Inc., Somerville, New Jersey, the Regional Director for the Second Region (New York City) shall within ten (10) days from the date of this Direction: (1) open and count the challenged ballots, other than the ballots of Catherine Dinunzio, Ruth Abbott, and Ethel Gorman; and (2) prepare and cause to be served on the parties a Supplemental Election Report embodying therein her findings and recommendations as to the results of the balloting. R-3401 and R-3403, respectively THIRD SUPPLEMENTAL- DECISION AND CERTIFICATION OF REPRESENTATIVES June 30, 1941 On January 30, 1942, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Elections in the above-entitled proceedings,' directing that separate elections be conducted among certain employees at the Bell Avenue plant and at the Doughty Avenue plant of Redfern Lace Works, Inc., Somerville, New Jersey, herein called 'the Company. On March 31, 1942, the Board issued a Supplemental Decision and Second Direction of Elec- tion,' setting forth the results of the balloting at the Bell Avenue plant and directing that a new election be held among the employees at the Doughty Avenue plant. On June 12, 1942,3 the Board issued a Second Supplemental Decision and Direction, setting forth the results of the new election and directing that the Regional Director open and count 18, challenged ballots therein ruled valid. On June 19, 1942, the Regional Director issued and duly served upon the parties a -Supplemental Election Report. No objections to the said report have been filed by any of the parties. L. 0. of A--------------------------------------------------- 33 Votes cast for neither____________________________________ 0 In the Decision and Direction of Elections dated January 30, 1942, the Board made no final determination as to the appropriate unit, but stated that such determination would depend in part upon the results of the elections. The Board stated : "If a majority of the employees in the Doughty Avenue plant select the United as their representative, they will constitute a separate and distinct bargain- ing unit; if a majority of them choose the Auxiliary and a majority of the Bell Avenue employees also express their desire to be repre- sented by the Auxiliary, then the employees at both plants shall constitute a single unit." The results of the elections show that the Auxiliary has been designated by a majority at each of the two plants. Upon the entire record in the case, the Board makes the following : SUPPLEMENTAL FINDING OF FACT All production and maintenance employees employed by the Com- pany at its Bell Avenue and Doughty Avenue plants, excluding weavers and office, clerical, and supervisory employees, constitute a unit appropriate for the purposes of collective bargaining, within the meaning of Section 9 (b) of the National Labor Relations Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended IT Is HEREBY CERTIFIED that Lace Workers' Auxiliary Section, Amal- gamated Lace Operatives of America, has been designated and se- lected by a majority of all production and maintenance employees at the Bell Avenue and Doughty Avenue plants of Redfern Lace Works, Inc., Somerville, New Jersey, excluding weavers and office, clerical ; and supervisory employees, as their representative for the purposes of collective bargaining and that, pursuant to Section 9 (a) of the Act, Lace Workers' Auxiliary Section, Amalgamated Lace Operatives of America, is the exclusive representative of all such employees for the ^ purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions, of employment.
