The Cross-Petitioner’s Request for Review of the Regional Director’s
administrative dismissal of the instant petitions is denied as it raises no substantial issues
warranting reversal of the Regional Director’s action. Accordingly, the dismissal is
affirmed.1

1 Member McFerran would deny review, relying on the fact that, while the first
bargaining session between the Intervenor and the Employer was not scheduled to begin
for at least seven months after the Employer assumed successor status, there is no
affirmative evidence that the duration of this seven-month interval was due to lack of
diligence or bad faith on the part of the Intervenor.
