The Di- rection of Election provided that an election by secret ballot be con- ducted within fifteen (15) days from the date of the Direction among all employees of North Star Specialty Manufacturing Co., Minne- apolis, Minnesota, herein called the Company, excluding clerical and supervisory employees and the experimental worker, who were on the pay roll of the Company on October 12, 1937, excepting those who had since quit or been discharged for cause, to determine whether they desired to be represented by International Association of Machinists, Local 382, or by United Electrical, Radio and Machine Workers of America, Local 1139, for the purposes of collective bargaining, or by neither. Pursuant to the Direction, an election by secret ballot was con- ducted on March 16, 1938. Full opportunity was accorded to all of the parties to this investigation to participate in the conduct of the secret ballot and to make challenges. On March 18, 1938, the Regional Director for the Eighteenth Region (Minneapolis, Minnesota), act- ing pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued his Inter- mediate Report upon the secret ballot, copies of which were duly served-upon the parties. No exceptions to the Intermediate Report have been filed by any of the parties. L R B 763 555 556 NATIONAL LABOR RELATIONS BOARD By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act and pursuant to Article III, Sections 8 and 9, of National' Labor Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY CERTIFIED that United Electrical, Radio and Machine Workers of America, Local 1139, has been designated and selected by a majority of all employees of North Star Specialty Manufactur- ing Co., Minneapolis, Minnesota, excluding clerical and supervisory employees and the experimental worker, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, United Electrical, Radio and Machine Workers of America, Local 1139, is the exclusive repre- sentative of all such employees for the purposes of collective bargain- ing in respect to rates of pay, wages, hours of employment, and other conditions of employment.
