Case No. R-2240 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES April 14, 1941 On January 23, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election'in the above-entitled proceedings? On February 28, 1941, pursuant to a stipulation by the parties, the Board issued a Supplemental Decision and Second Direction of Election.2 Pursuant to the Supplemental Decision and Second Direction of Election, an election by secret ballot was conducted on March 13, 1941, under the direction and supervision of the Regional Director for the Twenty-first Region (Los Angeles, California). On March 14, 1941, the Regional Di- rector, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. M. filed Objections and on"April 3, 1941, supplemental affidavits and objections, to the conduct of the ballot and to the Election Report, and requested a' hearing thereon. On March 24, 1941, the Regional Director issued his Report on Ob- jections, and on April 8, 1941, his Supplemental Report on Objec- tions, wherein he found that the objections raised no substantial or material issues with respect to the conduct of the ballot. On April 9,1941, the U. A. W. filed with the Board affidavits in opposition and in answer to the objections filed by the'I. A. M. The Board has fully considered the Election Report, the Objec- tions and supplemental objections and affidavits, the Supplemental Report on Objections, and the affidavits filed by the U. A. W. in opposition and in answer to the objections of the I. A. M., and finds that the Objections raise no substantial and material issues with respect to the conduct of the election or the Election Report. The objections are hereby overruled and the request for a hearing thereon is hereby denied. Since the counting of the challenged ballots would not affect the results of the election, it is unnecessary to make any determination with respect thereto. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board, by Section 9 (c) of the National Labor Re- lations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations Series 2, as amended, ' IT IS HEREBY CERTIFIED that,, International Union, United Automo- bile Workers of America, Local 683, C. I. 0., Aircraft Division, has been designated and selected by a majority of the production, inspec- tion, timekeeping, production control, store keeping, and mainte- nance employees of North American Aviation, Inc., Inglewood, California, including group and working leadmen, and excluding office workers, employees of the engineering department, welders, plant police, supervisors, officials who have the right to hire and discharge, and all other supervisory employees including and above the rank of assistant foremen, as their representative for the purposes of collective bargaining, and that pursuant to the provisions of Sec- tion 9 (a) of,the National Labor Relations Act, International Union, United Automobile Workers of America, Local 683, C. I. O. is the exclusive representative of all such employees for the purposes of collective' bargaining with respect to rates of pay, wages, hours of- employment and other conditions of employment.
