DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF TILE CASE On February 24, 1941, Metal Trades Department, American Fed- eration of Labor, herein called the M. T. D., filed with the Regional Director for the Thirteenth Region (Chicago, Illinois), a petition alleging that a question affecting commerce had arisen concerning the representation of employees at the Sandwich plant of New Idea, Inc., herein called the Company, engaged in the manufacture and assembly of farm equipment at Sandwich, Illinois, and requesting an investlga- - tion and certification of representatives, pursuant to Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, herein called the Act., On March 6,'1941, the National Labor Relations Board, herein called the Board, acting pursuant to Section 9 (c) of the Act, and Article III, Section 3, of National Labor Relations Board Rules and Regulations-Series 2, as amended, ordered an investigation and au- thorized the Regional Director to conduct it and to provide for an appropriate hearing upon due notice. On March 7, 1941, the Com- pany, the M. T. D., Farm Implements Workers Union, herein called the F. I W. U., and the attorney for the Board, entered into a "Stipu- lation for Certification Upon Consent Election." Pursuant to the stipulation, an election by secret ballot was conducted on March 14, 1941, under the direction and supervision of the Acting Regional Director, among all factory employees of the Company at its 30N L R B,No' 161 1154 NEW IDEA, INC. 1155 Sandwich plant, excluding straight clerical, office, and supervisory employees, to determine whether said employees desired to be rep- resented by the M. T. D. or the F. I. W. U., or by neither. On March 18, 1941, the Acting Regional Director issued and duly served upon the parties an Election Report on the ballot. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. - In the Election Report, 'the Acting Regional Director reported as follows concerning the balloting and its results : Total number on eligible list------------------------- --- ------------- 247 Total number of ballots cast -------------- ------ -- ------ ------ 244 Total number of ballots cast for the "F. D)---- 112 Total number of ballots cast for neither________________'------------------------ 1 Total number of ballots challenged--------------------------- 8 Total number of blank ballots-------------------------------- 0 Total number of void ballots ------------------------- - ------ 0 Since the eight challenged ballots could not affect the results of the election, the Acting Regional Director did not report or make any recommendations on said challenged ballots. Upon the basis of the stipulation, the Election Report, and the entire record in the case, the Board makes` the following : FINDINGS OF FACT 1. A question affecting commerce has arisen concerning the represen- tation of employees at the Sandwich plant of New Idea, Inc., Sandwich, Illinois, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. 2. All factory employees of the Company at its Sandwich plant, excluding straight 'clerical, office, and supervisory employees, con- stitute a unit appropriate for the purposes of collective bargaining, within the meaning of Section 9 (b) of the National Labor Relations Act. 3. Farm Implements Workers Union has been designated and se- lected by a majority of the employees in the above unit as their repre- sentative for the purposes of collective bargaining, and is the exclusive representative of all the employees in said unit, within the meaning of Section 9 (a) of the National Labor Relations Act.
