O. - Case No. R-0115 SECOND SUPPLEMENTAL DECISION AND ORDER June 17, 1941 On October 30; 1940, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above entitled proceedings.' Pursuant to the Direction of Election,- an election by secret ballot was conducted on November 25, 1940, under the direction and supervision of the Regional Director for the Thirteenth Region (Chicago, Illinois). On May 17, 1941, the Board issued a Supplemental Decision and Direction,2 which, among other things, directed the Regional Director to open and count six chal- lenged ballots. Pursuant to the Supplemental Decision and Direc- tion, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties a Supplemental Election Report, setting forth that on May 26, 1941, the Regional Director had opened the ballots, and that upon a count of such ballots the results of the election were as follows : Total on eligibility list------------------------------------- 61 Total ballots cast------------------------------------------- 57 Total ballots challenged------------------------------------- 6 Challenged ballots determined eligible ---------------------- 6 Challenged ballots determined not eligible -------------------- 0 Total blank ballots--------------- ------ -------------------- 0 Total void ballots------------------------------------------ o Total valid votes cast ----- ---------------------------------- 57 Votes cast for National Association of Die Casting `Yorkers, affiliated with the C. B., No. 127. 703 704 DECISIONS OF NATIONAL LABOR RELATIONS BOARD No objections to the counting of the ballots or to the Supplemental Election Report have been filed by any of the parties. The results of the, election show that no collective bargaining representative has been selected by a majority of the employees in the unit heretofore found to be appropriate for the purposes of collective bargaining. The petition for investigation and certification of representatives of employees of Herbert C. Johnson, doing business as National Die Casting Company, Chicago, Illinois, will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 99 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT Is HEREBY ORDERED that the petition for investigation and certi- fication of representatives of employees of Herbert C. Johnson, doing business as National Die Casting Company, Chicago, Illinois, filed by National Association of Die Casting Workers, affiliated with the C. I. 0., be, and it hereby is, dismissed.
