THE QUESTION CONCERNING REPRESENTATION The parties stipulated at, the hearing that both the S. F. U. and the U. F. U. have on numerous occasions in the past requested and do now request recognition as exclusive bargaining representative of the employees of the Company. The Company has refused to recog- nize either union pending certification by the Board. From a state- ment of Board agents introduced into evidence, it appears that each union has substantial membership among the employees of the Company. We find that a question has arisen concerning the representation of employees of the:Company.., IV. THE EFFECT OF THE QUESTION CONCERNING REPRESENTATION UPON COMMERCE We 'find"that the `question' concerning"representation which has arisen, oceurring'in connection' with`'ihe operations of the Company described' in Section I' above, hris a''cl'ose,' intimate`, and substantial relation to trade, traffic,, and commerce among the'several States, and tends to lead to' labor disputes bu'rd'eriing' and obstructing com- merce and the free flow of-6o ntmerce: rt r V. THE: APPROPRIATE UNIT The parties agreed and we find ,that; all crew, members working on. vessels, owned •or operated by members of the Company, except one representative of the, owner or,operator, on,each boat, constitute a unit appropriate for, the purposes of collective bargaining and that said unit will insure, to employees of the Company the full benefit of their right to self-organization, and•to,rcollective bargaining and otherwise effectuate the policies of the Act, VI. THE DETERMINATION OF" REPRESENTATIVES We, find that the question, concerning representation which has arisen can best be resolved by art' election by secret ballot. The U. . F.- U. contends that the, Company has engaged in unfair labor, practices, the effects, of which, have not, been dissipated, ' and that no fair election-can-be held until' after the close of the 1940-41 fishing season. There are at the present time no charges of unfair labor practices against the Company pending before the Board. On August 6, 1940, the•Board.enteredi an order approving a 'stipulation entered into by'the'Board', the Company, and the U: F. U. in settle- ment of charges of unfair labor practices. against the Company filed by the U.F. •U. on and prior toe June c28, 1.940. The stipulation re- cited, in part that it was entered ,into by, the parties in order to arrive, at an amicable settlement of the differences between them, and that it MONTEREY SARDINE INDUSTRIES, INC. 737 was not- to be, construed as an admission that unfair labor practices had been committed by the Company. It further recited that the, stipulation was to be a complete and final' disposition of all issues' raised by the charges of unfair labor practices and that the Company agreed to submit by appropriate petition all questions concerning the representation of the 'employees to the Board,.' -In view, of the stipu- lation and in the absence of any subsequent charges of unfaii labor practices we see no reason to postpone the election. We shall there- fore direct that the election be held' as soon as possible, -.but not later than 30 days from the date of our Direction. The U. F. U. contends that the crew of the New Madrid should, be eligible to vote in the election on the ground that the, New Madrid properly belongs to the Company -and !has been wrongfully excluded from membership. The Company denies that the New Madrid or its owners are entitled to a ' certificate of.membership. In view of, the Company's position, we cannot, say, on 'this,' record-, that the New Madrid is a member of the .Company. ' We shall therefore exclude. its crew from the election. • • I • . In accordance with our usual practice, we shall direct that, all the employees of the Company in the 'appropriate unit employed ' for, the 1940-1941 fishing season immediately preceding the date of this' Decision and Direction of Election shall be eligible to participate in the election. On the basis of the above findings of fact and upon the entire record in the proceeding, the Board makes the following: CONCLUSIONS OF LAW 1. A question affecting commerce has arisen concerning the repre- sentation of employees of Monterey Sardine Industries, Inc., Mon- terey, California, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. 2. All crew members working on vessels owned or operated by members of Monterey Sardine Industries, Inc., except one repre- sentative of the owner or operator on each boat constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the National Labor Relations Act.
