R-3.91 AMENDMENT TO DECISION AND DIRECTION OF ELECTIONS October 7, 1938 On September 29, 1938, the National Labor Relations Board, here- in called the Board, issued a Decision and Direction of Elections'. in the above-entitled proceeding. In paragraphs numbered 4 and 5 of the Direction the Board directed an election among certain categories of employees of DeBardeleben Coal Company and Coast Transportation Company, Inc., respectively, to determine whether they desire to be represented by International Longshoremen and Warehousemen's Union, affiliated with the Committee for Indus- trial Organization, for the purposes of collective bargaining. The Regional Director for the Fifteenth Region has advised the Board that the International Longshoremen's Association, affiliated with the American Federation of Labor, has requested that its name be 18 N. B., No. 15. 60 DECISIONS AND ORDERS 61 included on the ballot in the elections among the employees of the DeBarbeleben • Coal Company and the Coast Transportation Com- pany; Inc. and that the International- Longshoremen and Warehouse- men's Union has consented to the inclusion of the International Longshoremen's Association's name on the ballot. The Board hereby amends the Direction of Elections by striking therefrom paragraphs numbered 4 and 5 and by substituting there- for the following paragraphs numbered 4 and 5, respectively : 4. An election -shall be held aiiiong the' persons -employed at Mobile, Alabama, by DeBardeleben Coal Company to load coal on-ships, including coal trimmers,-coal checkers, and operators of the mechanical loading device, to determine whether they desire to be represented by International Longshoremen and Warehousemen's Union, affiliated with the Committee for In- dustrial Organization, or by International Longshoremen's As- sociation, affiliated with the American Federation of Labor, for the purposes of collective bargaining, or by neither. For the purpose of the election, a person employed as a coal trimmer is hereby defined as one who was so employed by DeBardeleben Coal Company during each of any 8 weeks between October 1, 1937, and March 31, 1938. 5. An election shall be held among the persons employed to load and unload barges, at Mobile, Alabama, by Coast Trans- portation Company, Inc., including barge laborers and clerks, 'and excluding foremen, to determine whether they desire to be represented by International Longshoremen and Warehouse- men's Union, affiliated with the Committee for Industrial Or- ganization, or by International Longshoremen's Association, affiliated with the American Federation of Labor, for the pur- poses of collective bargaining, or by neither. For the purpose of the election, a barge laborer is herein defined as one who was so employed by Coast Transportation Company, Inc. during each of any 8 weeks between October 1, 1937, and March 31, 1938. The Board further amends the Direction of Elections : (1) By striking from paragraph numbered 3 of the Direction the words and numbers, "Local No. 1430," and substituting therefor the words and numbers, "Local No. 1459." (2) By inserting in the next to last paragraph before the Conclu- sions of Law after the word "warehouseman" the words "or a banana handler," so that the paragraph, as amended, will read : "Where a warehouseman or a banana handler has been employed by more than one company during the period which we fixed for determining 62 NATIONAL LABOR RELATIONS BOARD eligibility, his eligibility to vote shall be determined from his aggre- gate employment at all companies, and he shall vote with the em- ployees of the company where he has had the greatest amount of employment during the eligibility period." (3) By inserting at the end of paragraph numbered 2 of the Di- rection the following sentence : "A person who has been employed as a banana handler during this period by more than one company shall vote with the employees of the company at which he has re- ceived the greatest amount of employment during this period." MR. DONALD WAKEFIELD SMITH took no part in the consideration of the above Amendment to Decision 'and Direction of Elections. [SAME TITLE] SUPPLEMENTAL DECISION CERTIFICATION OF REPRESENTATIVES AND ORDER November 9, 1938 On September 29, 1938, the National Labor Relations' Board, herein called the Board, issued a Decision, Direction of Elections, and Order, in the above-entitled proceeding. On October 7, 1938, the Board issued an Amendment to its Decision, Direction of Elections, and Order. Pursuant to the Direction of Elections, as amended, elections by secret ballot were conducted on October 14, 1938, by the Regional Director for the Fifteenth Region. Full opportunity was afforded all the parties to the investigation to participate in the conduct of the secret ballots and make challenges. On October 19, 1938, the Re- gional Director issued and on October 20, 21, 22, and 24, 1938, duly served upon the parties to the proceeding his Intermediate Report on the ballots. Turner Terminal Company has filed an objection to the Intermediate Report, which objection the Board has under consideration and which will not be treated in this Supplemental Decision. This was the only objection to the ballots or Intermediate Report which has been filed by any of the parties. Accordingly, no election was held for that group. Upon the entire record in the case, the Board makes the following : SUPPLEMENTAL FINDINGS OF FACT In its Decision the Board made no final determination as to the appropriate unit for the purposes of collective bargaining in so far DECISIONS AND ORDERS 67 as it: -related to persons employed to do longshore work and persons employed as clerks and checkers by the companies listed in appen- dix "E." 1 The Board decided that the final determination of the unit should depend upon the elections which it directed among these two groups. If both groups of employees chose the I. L. W. U. they. were together to constitute a single bargaining unit; if they did not, each group choosing to be represented by a union was to constitute a separate bargaining unit. In accordance with the above determination and the results of the elections, we find that all persons employed to do longshore work by the companies listed in appendix "E" including longshoremen and sack sewers and excluding clerks and checkers, banana handlers, walking bosses, wharf superintendents, assistant wharf superintend- ents, watchmen, timekeepers, dock sweepers, and warehousemen and carloaders, in so far as they are not employed as longshoremen, con- stitute a unit appropriate for the purposes of collective bargaining, and that said unit will insure the afore-mentioned employees the full benefit of their right to self-organization and collective bargaining, and otherwise effectuate the policies of the Act. We further find that the persons employed as clerks and checkers at Mobile, Alabama, by the companies listed in appendix "E" con- stitute a unit appropriate for the purposes of collective bargaining, and that said unit will insure to the afore-mentioned employees the full benefit of their right to self-organization and collective bargain- ing and otherwise effectuate the policies of the Act. THE TEXAS COMPANY Only. one person was eligible to vote at the election held among the employees of The Texas Company. Under these circumstances, and in accordance with our past decisions, we shall dismiss the peti- tion for investigation and certification of representatives of em- ployees of The. Texas Company.2 MOBILE STEVEDORING COMPANY, INC. Since no persons were eligible to vote at the election directed among the warehousemen employed by Mobile Stevedoring Com- pany, Inc., we shall dismiss the petition for investigation and cer- tification of representatives of employees of Mobile Stevedoring Company, Inc., in so far as it relates to those employed as ware- housemen. 1 Appendix "E" is the same as appendix "C" of the Decision. 2Matter of Luckenbach Steamship Company, et al., 2 N. Upon the basis of the above findings of fact and upon the entire record in the case, the Board makes the following: SUPPLEMENTAL, CONCLUSIONS OF LAW 1. All persons employed to do longshore work by the companies listed in appendix "E," including longshoremen and sack sewers, and excluding clerks and checkers, banana handlers, walking bosses, wharf superintendents, watchmen, timekeepers, dock sweepers, and warehousemen and carloaders, in so far as they are not employed as longshoremen, constitute a unit appropriate for the purposes of col- lective bargaining within the meaning of Section 9 (b) of the Na- tional Labor Relations Act. 2. The persons employed as clerks' and checkers at Mobile;;,Ala-' bama, by the companies listed in appendix "E" constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the National Labor Relations Act.
