Thompson’s order precluding testimony by the Respondent’s proposed expert witnesses and barring the Respondent from reasserting its argument that delays in this case violated its due-process rights is denied. The Respondent has failed to establish that the judge’s ruling cannot be appropriately addressed at a later stage of this proceeding. Moreover, argument in support of the request fails to show that the judge abused her discretion in finding that the proposed expert testimony would not assist her in understanding the evidence or in determining any fact in issue. Dated, Washington, D.C., April 18, 2018. LAUREN McFERRAN, MEMBER MARVIN E. KAPLAN, MEMBER WIILIAM J. EMANUEL, MEMBER 1 The National Labor Relations Board has delegated its authority in this proceeding to a three-member panel. Copy with citationCopy as parenthetical citation
