O. . - Case No. R-3685 SUPPLEMENTAL DECISION AND ORDER June ill 1942 On April 28, 1942, the National Labor Relations Board issued a Decision and Direction of-Election in the above-entitled proceeding.' Pursuant to the Direction of Election, an election by secret ballot was conducted on May 22, 1942, under the direction and supervision of the Regional, Director for the Eighteenth Region (Minneapolis, Minne- sota). On May 25, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2,,as amended, issued and duly served upon the parties an Election Report on the ballot. - As to the balloting and its results, the Regional Director reported as follows : - Total on eligibility list ------------------------------------- 3,315 Total ballots cast----------------------------------------- 3,065 Total ballots challenged____________________________42 Total blank ballots________________________________________ 4' Total void ballots --------------------------------------- - 3 Total valid votes counted_________________________________ 3,016 Votes cast for Local 838, U. F. of L--------------------------------------------- 333 Votes cast for neither organization_________________________ 1,400 In the Election Report, he recommended that the Board direct a run-off election between the U. A. W. and the I. A. M. On May 23, 1942, Local 838, United Automobile, Aircraft & Agricultural Imple- ment Workers of America, C. I. 0., herein called the U. A. On June 1, 1942, the Regional Director issued a Report on Objections to Election Report, finding that the objections are of a legal nature and referred'them to the-Board. On June 6,1942, the U. A. W. filed a document in support of a run-off election. Inasmuch as the-plurality of the votes in' the election were cast for neither of the competing labor organizations, the objections of the Company are hereby sus- tained. The request for a run-off election is hereby denied; no run-off election will be directed.2 Inasmuch as the results of the election show that no collective bargaining representative has been selected by a majority of the employees, the petition for investigation and certifica- tion of representatives of employees of John Deere Tractor Company and Iowa Transmission Company, Waterloo, Iowa, will therefore be dismissed. - ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49-Stat. 449, and pursuant to Article III, Sections 8-and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the petition for investigation and certifica- tion of representatives of employees'of John Deere Tractor Company and Iowa Transmission Company, Waterloo, Iowa, filed by Local 838, United Automobile, ,Aircraft & Agricultural Implement Workers of America, C.
