Case No. R4412 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES June 26, 1941 On April 24, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.' Pursuant to the Direction of Election, an election by secret ballot was conducted on May 3, 1941, under the direction and supervision of the Regional Director for the Fif- teenth Region (New Orleans, Louisiana). On May 5, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Election Report. As to the balloting and its results, the Regional . F. of L------------------------------------------- 132 Votes cast for NO UNION----------------------------------- 5 On May 12, 1941, United Textile Workers of America, Local 2595, affiliated with the American Federation of Labor, herein called the A. F. of L., filed Objections to the conduct of the election, accom- panied by signed statements in support of such Objections. On 131 N. L. R. B. 298. 32 N. L. H. B., No. 186. 1287 1288 DECISIONS OF NATIONAL LABOR RELATIONS BOARD May 13, 1941, the Regional Director issued and duly served upon the parties his Report on Objections to Election. On May 27, 1941, the A. F. of L. filed Exceptions to Report on Objections to Election, and on June 9, 1941, pursuant to leave granted, it submitted affidavits in support of its Objections. On June 16, 1941, the Regional Director issued a Supplemental Report on Objections to Election, stating that, with one exception the affidavits were identical with the signed state- ments previously filed by the A. F. of L. in support of its Objections. The Board has considered the Objections, the statements submitted in support thereof, the Report on Objections, the Exceptions to the Report on Objections, and the Supplemental Report 'on Objections. We find that the Objections raise no substantial or material issues with respect to the conduct of the ballot or the Election Report. The Objections are hereby overruled. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended. IT IS HEREBY OERTI$IED that Textile Workers Union of America, Local 386, affiliated with the C. I. 0., has been designated and selected by a majority of all hourly paid maintenance and produc- tion employees," and piece workers, of J. C. Sanders Cotton Mill ,Company, Inc., Prichard, Alabama, including second hands and yard boys, but excluding office and clerical help and overseers, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Textile Workers Union of America, Local 386, affiliated with the C. I. 0., is the exclusive representative of all such employees for the purposes of collective bargaining, with respect to rates of pay, wages, hours of employment, and other conditions of employment.
