R 2882, R-2883, and R-3233, respectively THIRD SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES June 27, 1942 On November 21, 1941 , the National Labor Relations Board issued a Decision and Direction of Election in this proceeding .' On Janu- ary 14, 1942 , the Board issued a Supplemental Decision and Certifica- tion of Representatives.2 On May 7, 1942 , the Board issued a Second Supplemental Decision and Direction of Elections ,' directing that separate elections be held among employees at the Bluff City Plant and at the Seventh Street Plant of International Shoe Company , Hannibal , Missouri , herein called the Company .' Pursuant to the Direction of Elections, elec- tions by secret 'ballot were conducted on May 21, 1942 , under the direction and supervision of the Regional Director for the Fourteenth Region ( St. Louis, Missouri ). On May 23, 1942, the Regional Direc- tor, acting pursuant to Article III, Section 9, of National Labor Rela- tions Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. 1.16 N L R B 1173. 238N L. R B 216 2 40 N L. R. B. 1211. • The Company 's three plants at Hannibal are called the Rubber Plant , the Bluff City Plant , and the Seventh Street Plant. On November 21, 1941 , the Board directed that an election be held among employees at the Rubber Plant. At that time the Bluff City Plant was closed . The Board deferred the elections to be held at the Bluff City Plant and at the Seventh Street Plant until the Bluff City Plant should be in operation. 41 N L. R. I. 0--------------------------------------- 576 Number of ballots voted for Western Brotherhood of Shoe and Rubber Workers----------------------------------- 129 Number of ballots voted for neither----------------------- 301 In the original Decision and Direction of Election, issued on No- vember 21, 1941, the Board stated that upon the results of separate elections among employees at each of the Company's three Hannibal plants should depend in part the appropriate unit. The Board pro- vided that United Rubber Workers of America, Local #198, affiliated with the C. I. 0., herein called the Rubber `Wrorkers, and Western Brotherhood of Shoe and Rubber Workers, herein called the Brother- hood, should participate in the election among employees at the Rubber Plant, stating that "if a majority of such employees select the Rubber Workers as their bargaining agent, we shall find that such employees constitute an appropriate bargaining unit and shall certify the Rubber Workers as their bargaining agent." The Board further provided that the Brotherhood and United Shoe Workers of America, C. I. 0., herein called the Shoe Workers, should partici- pate in elections to be held among employees at the Bluff City Plant and at the Seventh Street Plant, stating "if the Brotherhood or the United Shoe Workers of America be selected by a majority of em- ployees at each of two or more plants, we shall find that such em- ployees constitute a single appropriate unit and shall certify as bargaining agent thereof the representative so selected." 1404 DECISIONS OF NATIONAL LABOR -RELATIONS BOARD In the Supplemental Decision and Certification, of Representatives issued on January 14, 1942, the Board, noting that a majority of employees at the Rubber Plant had selected the Rubber Workers as their bargaining agent, found that employees at `the Rubber Plant constituted an appropriate unit and certified the Rubber Workers as their exclusive bargaining agent. The results of the separate elec- tions held at the Bluff City Plant and at the Seventh Street Plant disclose that a majority of employees at each plant has selected the Shoe Workers as their exclusive bargaining agent. Upon the entire record in the case, the Board makes the following : SUPPLEMENTAL FINDING OF FACT We find that all production and maintenance employees of the Company at the Bluff City Plant and at the Seventh Street Plant, Hannibal, Missouri, excluding clerical, office, and supervisory employ- ees, bonded watchmen, and cafeteria employees, constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the National Labor Relations Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, ,IT IS HEREBY CERTIFIED that United Shoe Workers of America, C. I. 0., has been designated and selected by a majority of all production and, maintenance employees of International Shoe Com- pany at the Bluff City Plant and the Seventh 'Street Plant, Hannibal, Missouri, excluding clerical, office, and supervisory employees, bonded watchmen, and cafeteria employees, as their representative for the purposes of collective bargaining and that, pursuant to Section 9 ('a) of the Act, United Shoe Workers of America, C. I. 0., is the' exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of 'pay, wages, hours of employment, and other conditions of employment.
