R-2507 and R-2508 Investigation and Certification of Representatives : run-off election directed. SUPPLEMENTAL DECISION SECOND DIRECTION OF ELECTION AND CERTIFICATION OF REPRESENTATIVES' July 11, 1941 On May 22, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Elections in the above-entitled proceeding.' Pursuant to the Direction of Elec- tions, elections by secret ballot were conducted on June 18, 1941, under the direction and supervision of the Regional Director for the Thirteenth Region (Chicago, Illinois). On June 20, 1941, the Regional Director, acting pursuant to Article III, Section 9, of the National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Re- port, on the ballot. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. Union_________________________ 2682 Total ballots cast for neither________________________________ 206 Since the number of challenged ballots cannot affect the result of the election, we find it unnecessary to pass upon the challenges. On July 2, 1941, the C. I. O. Union filed a request for a run-off election to be held by the Board. Although neither of the com- peting labor organizations in the election among -production and maintenance employees received a majority of the votes cast, the re- sults of the election show that a majority of the employees in ques- tion desire to bargain collectively with, the Company. Accordingly, we shall direct a run-off election in which such employees will be given an opportunity to decide whether they desire to be represented by Farm Equipment Workers Organizing Committee, affiliated with the Congress of Industrial Organizations, or by Federal Labor Union, No. 22604, affiliated with the American Federation of Labor, for the purposes of collective bargaining. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, it is hereby DIRECTED that, as part of the investigation authorized by the Board to determine representatives for the purposes of collective bargaining with International Harvester Company, Chicago, Illinois, an elec- tion by secret ballot shall be conducted as early as possible, but not 'later than thirty (30) days from the date of this Second Direction of Election, under the direction and supervision of the Regional Director for the Thirteenth Region, acting in this matter as agent for the National Labor Relations Board and subject to Article III, Section 9, of said Rules and Regulations, among the production and maintenance employees described in the Direction of Election issued May 22, 1941, but excluding those who have since quit or been dis- charged for cause, to determine whether they desire to be represented I'NT'E'RNATTONAL HARVESTER C'OMP'ANY 335 by Farm Equipment Workers Organizing Committee, affiliated with the Congress of Industrial Organizations, or by Federal Labor Union, No. 22604, affiliated with the American Federation of Labor, for the purposes of collective bargaining. , IT IS HEREBY CERTIFIED that Pattern Makers League of North America, Chicago Association, affiliated with the American Federa- tion of Labor, has been designated and selected by a majority of all pattern makers and pattern makers' apprentices at the McCormick Works of International Harvester Company, as their representative for the purpose of collective bargaining, and that pursuant to Section 9 (a) of the Act, Pattern Makers' League of North America, Chicago Association, affiliated with the American Federation of Labor, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
