Case No. R-2128 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES March 13, 1941 On December 30, 1940, the National Labor Relations Board, herein called the Board , issued a Decision and Direction of Election in the above=entitled' proceeding .' Pursuant to the Direction of Election, an election by secret ballot was conducted on January 29, 1941, under the direction and supervision of the, Regional Director for the Second Region ( New York City ). On January 31, 1941 , the Regional Direc- tor, acting pursuant to Article III, Section 9, of_ National Labor Re- lations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report on the ballot. As to the balloting and its results ; the Regional Director reported as follows : Total number eligible to vote___________ _____________________ 62 Total number of ballots cast__________________--------------------------------- 50 Total number of valid ballots_______________________________ 42 Total number of votes in favor of local B, 1010, International Brotherhood of Electrical Workers, A. I. 0_____________ 6 Total number of votes in favor of neither union --------------- 0 Total number of blank votes_________________________________ 0 Total number of void ballots-------------------------------- 0 Total number of challenged votes___________________________ 8 On February 8, 1941 , Objections to the Election Report were filed by Local 430 , United Electrical , Radio & Machine Workers of Amer- ica, herein called the United.2 On February 27, 1941 , the Regional Director issued a Report on Objections to Election , referring the 128 N L R B 809. 2 The United also moved for permission to argue its objections orally before the Board. We have considered the Objections to the Election Report of the United and are of the opinion that, they raise no substantial or mate- rial issues with. respect to-the conduct.of the election.,, The objections are hereby overruled. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that -Local B-1010, International Brother- hood of Electrical Workers,' affiliated with the American Federation of Labor, has been designated and selected by a majority of all pro-, duction' employees of Insuline Corp. of America, Inc., Long 'Island City, New York, including employees in the machine shop, press de- partment, inspection assembly, aerial-bench, receiving 'and .shipping 'departments, and stockroom employees, but excluding porters, office and clerical employees,'designing engineers, -foremen, superintendents, and executives, as their representative for the.purposes of.collective bargaining; and that, pursuant to; Section 9 (a) of the Act, Local B-1010, International Brotherhood of- Electrical Workers, affiliated with the American Federation of Labor, is the exclusive representa- tive of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment; and .other conditions of employment. - C ^+ Copy with citationCopy as parenthetical citation
