ORDER DENYING MOTIONS
The Respondent’s motion to dismiss the consolidated complaint in Cases 15-CA-
095044 and 15-CA-090828 is denied. In addition, the Respondent’s motion to dismiss
the original complaint in Case 15-CA-095044 is also denied. The Respondent has
failed to establish that it is entitled to judgment as a matter of law.1

1 The Respondent contends that the Board does not have a valid quorum under Noel
Canning v. NLRB, 705 F.3d 490 (D.C. Cir. 2013), and that therefore the Board has no
subject matter jurisdiction over the claims contained in the consolidated complaint. For
the reasons stated in Bloomingdale’s, Inc., 359 NLRB No. 113 (2013), these arguments
are rejected.
