'- Case No.'R-2245 1 0 SUPPLEMENTAL DECISION AND ORDER April 23, 1941 On January 31, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding .11 Pursuant to the Direction of Election, an election by secret ballot was conducted on February 25, 1941, on board the Steamers A. B. Sheets, Henry A. Roemer, J. H. Hillman, and Joe Carter, under the direction and supervision of the Regional Director for the Sixth Region (Pittsburgh, Pennsylvania). On March 3, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon National Maritime Union of America, Inland Boatmen's Divi- sion, affiliated with the C. 1. 0., herein called the N. M. U., and Hillman Transportation Company, herein called the Company. As to the balloting and its results, the Regional Director reported as follows : Total number eligible ---------------------------------------- 64 Total number of ballots cast________________________________ 64 Total number of ballots cast for National Maritime Union of America, Inland Boatmen's Division, affiliated with the C I. 0--------------------------------------------------- 25 Total number of ballots cast against National Maritime Union of America, Inland Boatmen's Division, affiliated with the C. M. U.. filed with the Regional Director Objections' to the Election, in which it requested that the balloting 129 N. L. R. B. 332. 31 N. L. R. B., No. 39. 256 , - HILLMAN TRANSPORTATION COMPANY 257 be declared null and void and that hearings be held to determine the validity of its objections. The N. M. U.,objected to the election, in substance, on the grounds that the Company had coerced employees in the exercise of their rights to select representatives of their own choosing. On April 5, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued his Report on Objec- tions, copies of which were duly served upon the parties. The Board has considered the Election Report, the Objections to the Election filed by the N. M. U., and the Report on Objections, and finds that the objections filed by the N. M. U. do not present substan- tial or material issues with respect to the conduct of the ballot or Election Report. The results of the election show that no collective bargaining rep- resentative has been selected by a majority of the employees in the appropriate unit. We shall therefore, dismiss the N. M. U.'s petition. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9 of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the petition for, investigation and certifi- cation of representatives of employees of Hillman Transportation Company, Pittsburgh, Pennsylvania, filed by National Maritime Union, Inland Boatmen's Division, affiliated with the C.
