FREDERICK WILLIAMS 2 ORDER1 The General Counsel’s request for special permission to appeal the October 25, 2017 oral ruling on the record and November 24, 2017 written order of Administrative Law Judge Paul Bogas granting in part the petitions to revoke subpoenas duces tecum B-1-YFWQ5T, B- 1-YFWQDB, B-1-YFWUUP, and B-1-YFWODN, his rulings concerning the exclusion of certain related testimony and exhibits, and his rulings concerning cross-examination of witnesses is denied on the ground that the request was not made "promptly," as required by Section 102.26 of the Board's Rules and Regulations. We deny the request on timeliness grounds and do not reach the underlying merits of the appeal. This denial is without prejudice to the General Counsel's right to renew its arguments before the Board on any exceptions that may be filed to the judge’s decision, if appropriate.
