The General Counsel’s motion to reopen or supplement the record is denied under
Section 102.48(d) of the Board’s Rules and Regulations. See USF Red Star, Inc., 339
NLRB 389, 389 fn. 3 (2003) (applying Section 102.48(d) in ruling on a motion to reopen
a record filed after issuance of an administrative law judge’s decision but before issuance
of a Board decision). The documents sought to be entered are neither newly-discovered
nor were they unavailable at the time of the hearing. In addition, Counsel for the General
Counsel has not shown why this evidence need be included at this time, and if included,
why this evidence would require a different result.
