May. 28, 2020) Copy Citation UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD GENESEE COUNTY 911 CONSORTIUM COMMISSION Employer and Case 07-WH-257610 POLICE OFFICERS LABOR COUNCIL (POLC) Petitioner CORRECTED CERTIFICATION OF REPRESENTATIVE AS BONA FIDE UNDER SECTION 7(b) OF THE FAIR LABOR STANDARDS ACT OF 1938 On March 6, 2020, the Police Officers Labor Council (POLC) (the Petitioner) filed with the Regional Director for Region 7 of the National Labor Relations Board a request for certification of representative as bona fide under Section 7(b) of the Fair Labor Standards Act of 1938 (FLSA), 29 U.S.C. § 207(b). On April 1, 2020, the Regional Director for Region 13 served on the parties a Notice to Show Cause why the Board should not grant the request.1 No response was filed. As the Region’s investigation revealed that the Petitioner is the recognized exclusive collective-bargaining representative of the unit employees,2 the Regional Director recommended to the Board that the requested certification be issued. 1 Although the Notice to Show Cause was inadvertently dated “30th day of April 1, 2020,” the Regional Director’s letter dated April 27, 2020, indicates that a copy of the Notice to Show Cause was sent to the Employer on April 1, 2020. The record indicates that the Notice to Show Cause was filed with the Board on April 1, 2020. We correct the date for the purposes of this order. 2 The record indicates that prior to the issuance of the Notice to Show Cause, the Employer in a letter dated March 16, 2019, informed the Region that the Petitioner is the exclusive collective-bargaining representative of the bargaining-unit 2 No party having shown cause why the requested certification should not be issued, the National Labor Relations Board certifies that the Police Officers Labor Council (POLC) is a bona fide representative, for purposes of Section 7(b) of the FLSA, of the employees in the following unit:3 All regular full-time supervisors employed by Genesee County 911 Consortium Commission at its Central Dispatch Facility at G-4481 Corunna Road, Flint, Michigan; excluding guards, dispatchers, office clerical and all other employees. The Employer has recognized the Petitioner as the collective-bargaining representative of its employees in the unit and embodied such recognition in the terms of the parties’ collective-bargaining agreement for the period of September 30, 2019 through September 30, 2022. 3 A certificate of representative as bona fide for purposes of the FLSA does not necessarily establish the certified organization’s right to be recognized as the exclusive bargaining representative under the provisions of the National Labor Relations Act.
