CERTIFICATION OF REPRESENTATIVES
July 24, 1941
On January 24, 1941, the National Labor Relations Board, herein
called the Board, issued its Decision and Direction of Election in the
above-entitled proceeding.' Pursuant to the Direction of Election an
election by secret, ballot was conducted on February 13, 1941, under
the direction and supervision of the Acting Regional Director for
the Second Region (New York City). On Jude 23, 1941, the Board
issued a Supplemental Decision and Direction 2 which, inter alla,
directed the Regional Director to open and count three challenged
ballots.3 On July 2, 1941, the Regional Director, acting pursuant to
Article III, Section 9, of National Labor Relations Board Rules and
Regulations-Series 2, as amended, issued her Supplemental Election
Report, copies of which were duly served upon the parties.
In her Supplemental Election Report the Regional Director re-
ported that on June 30, 1941, the three challenged ballots referred
to, were opened under the supervision of her agent and counted with
the other ballots cast in the election, and that the final tabulation of
the result of the balloting was as follows :

On June 26, 1941, Radio Union, Local B-1010, International Brotherhood of Electrical
Workers, affiliated with the American Federation of Labor, wrote to the Board protesting
against the Supplemental Decision and Direction as "entirely contrary to the evidence
and facts," and setting forth various allegations in support of the protest . We find the
protest without merit. The protest Is hereby overruled.

No objections to the counting of the challenged ballots or to the
Supplemental Election Report have been filed by any of the parties.
By virtue of and pursuant to the power vested in the National
Labor Relations Board by Section 9 (c) of the National Labor Re-
lations Act, and pursuant to Article III, Sections 8 and 9, of National
Labor Relations Board Rules and Regulations-Series 2, as
amended,
IT IS HEREBY CERTIFIED that Local 430 of the United- Electrical,
Radio & Machine Workers of America, C. I. 0., has been designated
and selected by a majority of the employees in the production de-
partments of Garod Radio Corporation, Brooklyn, New York, in-
cluding working supervisors, but excluding engineering, laboratory,
watchmen, porters, maintenance, and toolroom, time-study men, time-
keepers, experimental workers, foremen, non-working supervisors,
stockroom employees, shipping and receiving room employees, office,
clerical, and all other non-production employees, as their representa-
tive for the purposes of collective bargaining, and that, pursuant to
the provisions of Section 9 (a) of the Act, Local 430 of the United
Electrical, Radio & Machine Workers of America, C. I. 0., is the
exclusive representative of all such employees for the purposes of
collective bargaining in respect to rates of pay, wages, hours of
employment, and other conditions of employment.
