F. OF L. Case No. R-3045 CERTIFICATION OF REPRESENTATIVES December 20, 1941 On October 28, 1941, the National Labor Relations Board issued its Decision and Direction of Election in the above-entitled proceeding.' Pursuant to the Direction of Election an election by secret ballot was conducted on November 19, 1941, under the supervision of the Re- gional Director for the Fifteenth Region (New Orleans, Louisiana). On November 26, 1941, the Regional Director, acting pursuant to Article III, Section 9, of the National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties. No objections to the conduct of the ballot or to the Election Report were filed, by any of the parties. As to the balloting and the results thereof, the Regional Director reported as follows : Total on eligibility list--------------------------------------- 162 Total ballots cast------------------------------------------- 145 Total ballots challenged -------------------------------------- 3 'Total blank ballots------------------------------------------ 0 Total void ballots------------------------------------------- 1 Total valid votes counted----------------------------------- 141 Votes cast for International Brotherhood of Boilermakers, Iron Shipbuilders, Welders and Helpers of America, affiliated with the A. F. of L--------------------------------------- 50 Since the number of challenged ballots cannot affect the results of the election, we find it unnecessary to pass upon the challenges. IT Is HEREBY CERTIFIED that International Brotherhood of Boiler- makers, Iron Shipbuilders, Welders and Helpers of America, affili- ated with the American Federation of Labor, has been selected by a majority of all employees of Food Machinery Corporation, Amphib- ian Tractor Division, Lakeland, Florida, included in the classifica- tions listed in Board Exhibit 5,2 except the tune-study man who is listed as a storekeeper, as their representative for the purposes of col- lective bargaining and that pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, International Brotherhood of Boilermakers, Iron Shipbuilders, Welders and Helpers of America, affiliated with the American Federation of Labor, is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment. 2 For the classifications listed in Board Exhibit 5, see the Board's Decision and Direction of Election in this proceeding, 36 N.
