DECISION
AND
ORDER
Upon a petition duly filed, a hearing was held before Francis E.
Burger, hearing officer. The hearing officer's rulings made at the
hearing are free from prejudicial error and are hereby affirmed.
Pursuant to the provisions of Section 3 (b) of the National Labor
Relations Act, the Board has delegated its powers in connection with
this case to a three-member panel [Members Reynolds, Murdock, and
Styles].
Upon the entire record in this case, the Board finds :
The Business of the Employer
The Employer operates five ladies' ready-to-wear and accessory
retail stores all within the State of Michigan. During the calendar
year 1949, the Employer purchased merchandise valued at approxi-
mately $210,000, all of which was shipped from points outside the
State of Michigan. During the same period the Employer's gross
sales amounted to approximately $300,000, all of which were retail
sales within the State of Michigan.
The Employer denies that the Board has jurisdiction in this matter.
Although we do not find that the Employer's operations are unrelated
to commerce, we are of the opinion that its operations are essentially
local in character and that to assert jurisdiction in this case would
not effectuate the policies of the Act.2 Accordingly, we shall dismiss
the petition.
ORDER
IT IS HEREBY ORDERED that the petition for investigation and cer-
tification of representatives filed herein be, and it hereby is, dismissed.
