Pursuant to the Direction of Election, an election by secret ballot Was conducted on October 28, 1941, under the direction and supervision of the Regional Director for the Second Region (New York City). On December 5, 1941, the Board issued a Supplemental Decision and Direction,2 directing that the Regional Director open and count certain challenged ballots. On December 12, 1941, the Regional Director, acting pursuant to Article III, Sec- tion 9, of National Labor Relations Board. Rules and Regulations- Series 2, as amended, issued a Supplemental Election Report, copies of which were duly served-upon the parties. No objections to the Supplemental Election Report have been filed by any of the parties. As to the final results of the balloting, the Regional Director re- ported as follows: Total on eligibility list------------------------------------- 10 Total ballots cast---------------------- --------------- 19 Total ballots challenged-------------------------------------- 0 Total blank ballots------------------------------------------ 0 Total void ballots------------------------------------------- 0 Total valid votes counted including the challenged ballots held valid by the National Labor Relations Board---------------- 19 Votes cast for American Federation of Office Employees, Local 20940 - ---------------------------------------- 9 Votes cast against aforementioned union---------------------- 10 The results of the election show that no collective bargaining repre- sentative has been selected by a majority of the employees of Edward 136 N L R B. 64 2 37 N L . The petition for investigation and cer- tification of representatives of employees of the Company, filed by American Federation of Office Employees , Local 20940 , will, therefore, be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT Is HEREBY ORDERED that the petition for investigation and cer- tification of representatives of employees of Edward & John Burke, Ltd., Long Island City, New York, filed by American Federation of Office Employees, Local 20940, be, and it hereby is, dismissed.
