Case No. RE-16 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES May 9, 1941 On January 24, 1941, the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Election in the above-entitled proceeding.' Pursuant to the Direction of Election, en election by secret ballot was conducted on March 6, 1941, under the direction and supervision of the Regional Director for the Seventh Region (Detroit, Michigan). On March 7, 1941, the Regional Direc- tor, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties. • As to the balloting and the results thereof, the Regional Director reported as follows : Total on eligibility list____ ________________________________ 30 Total ballots ca 'st----------------------------------------- 29 Total ballots challenged___________________________________ O Total blank ballots________________________________________ 0 Total void ballots_________________________________________ 0 Total valid votes cast_____________________________________ 29 Votes cast for National Organization of Masters , Mates and Pilots of America, A . O.)__ 6 Votes cast for Neither__________________________________ 0 On March 10, 1941, the Great Lakes Officers Association, (C. I. 0.), herein called the Association, filed with the Regional Director for the Seventh Region its "Objections to Election" and on March 14, 1941, its "Amended Objection" in each of which is set forth certain objec- tions to the conduct of the election and to the Election Report. 129 N. B., No. 116. 698, DETROIT & CLEVELAND NAVIGATION COMPANY 699 On March 27, 1941, the Regional Director for the Seventh Region, acting pursuant to Article III, Section 9, of the Rules and Regula- tions, issued his Report on Objections setting forth that he had duly investigated the matters set forth in the aforesaid objections, and recommending that the Board find that no substantial and material issues . had been raised thereby with respect to the conduct of the ballot or to the Election Report. The Board has considered the matters specified in the Objections, filed herein by the Association, and on the basis of the above-men- tioned Election Report, Objection to Election, Amended Objections, and Report on Objections, finds that no substantial or material issues with respect to the conduct of the ballot or to the' Election Report have been raised thereby. Accordingly, we hereby overrule said objections and affirm the rulings, findings, and recommendations of the Regional Director in his Election Report and Report on Objections. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board, by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of the National Labor Relations Board Rules and Regulations- Series 2, as amended, IT IS HEREBY CERTIFIED that National Organization of Masters, Mates and Pilots of America, A. F. of L., has been designated and selected by a majority of all licensed deck officers, excluding captains, employed on all boats owned or operated by Detroit & Cleveland Navigation Company, Detroit, Michigan, as their representative for the purposes of collective bargaining, and that pursuant to the pro- visions of Section 9 (a) of the National Labor Relations Act, National Organization of Masters, Mates and Pilots of America, A. F. of L. is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
