Case No. R-2868 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES December 9, 1941 On October 24, 1941, the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Election in the above-entitled proceeding.' Pursuant to the Direction of Election, an election by secret ballot was conducted on November 12, 1941, under the direction and supervision of the Regional Director for the Ninth Region (Cincinnati, Ohio). On November 13, 1941, the Re- gional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties. As to the balloting and its results, the Regional Director, reported as follows : Total on eligibility list------------------------------------ 515 Total ballots cast------------------------------------------ 504 Total ballots challenged----------------------------------- 0 Total blank ballots---------------------------------------- 0 Total void ballots----------------------------------------- 0 Total valid votes counted---------------------------------- 504 Votes cast for Transport Workers Union No 208------------ 285 Votes cast for The Amalgamated Association of Street, Electric Railway and Motor Coach Employees of America, Division 1111------------------------------------------- 205 Votes cast for neither------------------------------------- 14- On November 15, 1941, Columbus & Southern Olio Electric Com- pany, herein called the Company, filed with the Regional Director Objections and Exceptions to the Election Report solely on the ground that the Board has no jurisdiction in the premises. On November 19, 1941, the Regional Director, acting pursuant to Article 136 N L R B. 386 37 N. L R. B, No. 67 403 404 DECISIONS OF NATIONAL LABOR RELATIONS BOARD III, Section 9, of National Labor Relations Board Rules and Regu- lations-Series 2, as amended , issued and duly served upon the' parties his Report on Objections , stating that the Objections and Exceptions raised no substantial and material issues. The Board has, considered the Company's Objections and Excep- tions to the Election Report and the Regional Director 's Report on Objections. Since the Board has previously determined in its De, cision and Direction of Election that the Company is within the jurisdiction of the Board, the Board finds that the Objections and Exceptions raise no substantial or material issues with respect to the conduct of the ballot or the Election Report, and- they are hereby overruled. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act , 49 Stat. 449 , and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Transport Workers Union, Local 208, affiliated with the Congress of Industrial Organizations, has been designated and selected by a majority of the employees of the trans- portation division of Columbus &, Southern Ohio Electric Company, Columbus, Ohio, including working foremen,` but excluding operating foremen, supervisors, foremen having authority to hire and discharge, clerical employees in the office of the superintendents, and all persons employed in the transportation division, other than car, coach, and bus operators, who have any connection with the sale and distribution of tickets and transfers and/or the collection of the transportation- division operating receipts, as their representative for the purposes of collective bargaining, and that pursuant to Section 9 (a) of the National Labor Relations Act, Transport Workers Union, Local 208, affiliated with the Congress of Industrial Organizations, is the exclusive representative of all such employees for the purposes of collective bargaining iii respect to rates of pay, wages, hours of employment, and other conditions of employment.
